산업재해 예방의 틀이 지방자치단체로 확장되고 있다

산업안전보건법이 오랫동안 정부·사업주·근로자 3자를 중심으로 설계되어 왔다면, 최근의 변화는 그 틀에 지방자치단체라는 네 번째 축을 더하고 있다.

산업안전보건법을 읽어 온 이들에게 이 법의 기본 구도는 익숙하다. 정부는 정책을 수립하고, 사업주는 안전한 작업환경을 만들 의무를 지며, 근로자는 안전수칙을 지킬 책임을 진다. 이 삼각 구도는 오랫동안 산업안전보건법의 뼈대로 작동해 왔으며, 대부분의 실무 교육과 컨설팅 역시 이 세 주체를 중심으로 설계되어 왔다.

그런데 이 구도에 지방자치단체가 하나의 책무 주체로 더해진 지 이제 몇 해가 지났으며, 정부의 정책에 협조하고 관할 지역의 산업재해를 예방하기 위한 대책을 스스로 수립·시행해야 한다는 규정이 법 안에 자리를 잡았다. 그리고 이 규정을 근거로 전국 대다수의 지방자치단체가 저마다의 산업재해 예방 조례를 두고, 그 조례를 통해 지역 단위의 산업안전보건 활동을 구체화하고 있다.

왜 지방자치단체까지 책무를 지게 되었는가

산업안전보건법이 정부에 부여한 책무는 산업 안전·보건 정책의 수립과 집행, 예방기법의 연구·보급, 안전문화 확산을 위한 홍보와 교육, 산업재해 통계의 유지·관리 등 국가 차원의 정책 설계와 집행 기능에 가깝다. 이는 산업재해 예방을 개별 사업장의 자율에만 맡기지 않고, 국가가 제도적 기반과 방향성을 제시하는 역할을 맡는다는 뜻이며, 한국산업안전보건공단과 같은 전문기관에 행정적·재정적 지원을 함으로써 이 기능을 보다 효율적으로 수행하려는 구조도 함께 마련되어 있다.

다만 정부 차원의 정책만으로는 지역마다 다른 산업 구조와 위험 요인을 촘촘히 담아내기 어렵다는 문제의식이 뒤따랐고, 이 지점에서 지방자치단체의 역할이 새롭게 규정되었다. 관할 지역 내 산업재해를 예방하기 위한 자체 계획의 수립, 교육·홍보, 안전한 작업환경 조성을 위한 사업장 지도 등을 지자체가 직접 수행할 수 있도록 근거를 마련한 것이며, 이는 전국 단위의 정책과 지역 단위의 실행 사이에 놓인 간극을 메우려는 시도로 읽힌다.

조례 안에 담긴 것들

지방자치단체가 이 책무를 구체화하는 방식은 대부분 조례를 통해서다. 그리고 조례 안에는 각기 다른 방식으로 산업재해의 여러 국면을 겨냥하는 제도들이 담겨 있다.

가장 눈에 띄는 것은 노동안전지킴이 제도로, 사업장 또는 노동 현장에서 위해 요소를 발굴·조사·개선·지도하는 인력을 지역 차원에서 운영하는 방식이다. 이는 정기 감독만으로는 포착하기 어려운 현장의 세부 위험을 발굴하는 보완적 안전망의 성격을 지니며, 특히 감독 인력이 상대적으로 닿기 어려운 소규모 사업장에서 의미를 갖는다.

노동안전보건 우수기업 인증 제도는 경영지원자금 지원이나 지방세 감면 같은 경제적 유인을 통해 사업주의 자발적 참여를 이끌어 내려는 설계다. 산업재해 예방을 단속과 처벌의 언어가 아니라 지원과 인센티브의 언어로 풀어내려는 접근이며, 특히 안전관리에 투자할 여력이 크지 않은 중소규모 사업장에게 실질적인 동기를 제공하는 장치로 기능한다.

산업재해 예방 실행계획의 매년 수립은 지역 내 산업재해 발생 현황과 업종별 실태를 분석해 그해의 대책과 예산 규모를 정하는 절차로, 조례가 일회성 선언에 그치지 않고 매년 갱신되는 구체적 계획으로 이어지도록 하는 장치에 해당한다. 여기에 노동안전보건 강조기간과 산업재해노동자의 날 같은 규정은 안전 의식을 사회 전반의 흐름 속에서 상기시키는 캠페인성 장치로, 개별 사업장의 노력을 지역 사회 차원의 관심으로 확장시키는 역할을 한다.

조례의 지원 대상 조항을 살펴보면 이 제도들이 겨냥하는 지점이 보다 뚜렷해진다. 상시 노동 인원이 적은 소규모 사업장, 토목·건설 현장, 화물트럭기사와 같은 특수형태 노동자, 상하수 관리나 청소 등 공공부문의 위험 외주 사업장, 외국인 이주 노동자 등이 주로 지원 대상으로 규정되어 있으며, 이는 법의 주된 규율 체계에서 상대적으로 비켜나 있는 취약 지대를 지역 행정이 직접 챙기겠다는 의도로 읽을 수 있다.

최근에는 과로사 예방 지원 사업이 조례에 새롭게 담기며 산업재해의 개념이 신체적 재해를 넘어 순환계 질환이나 심리적 스트레스에 따른 정신질환까지 포괄하는 방향으로 넓어지고 있으며, 디지털 AI 기술 도입 지원 조항이 최근 추가된 점도 산업재해 예방의 방법론이 전통적인 점검·교육 방식에서 기술 기반 예방으로 확장되고 있음을 보여준다. 이는 조례가 시대적 변화에 맞춰 지속적으로 개정되며 예방의 범위를 넓혀 가고 있다는 것을 뜻한다.

사업장이 이 구조를 어떻게 활용할 수 있는가

산업재해 예방의 책무 주체가 정부와 사업주, 근로자를 넘어 지방자치단체로까지 확장되었다는 것은, 사업장 입장에서 활용할 수 있는 자원의 폭이 그만큼 넓어졌다는 뜻이기도 하다. 위험성평가나 자체 점검, 안전보건 교육을 준비하는 과정에서 관할 지자체가 운영하는 지원 사업과 인증 제도를 함께 살펴보는 일은, 사업장이 스스로 갖추기 쉽지 않은 자원을 보완하는 실질적인 경로가 될 수 있다.

For anyone who has spent time with Korea's Occupational Safety and Health Act, the basic architecture is familiar. Government sets policy, employers carry the duty to build safe workplaces, and workers carry the duty to follow safety rules. This three-party structure has long served as the backbone of the law, and most training programs and consulting engagements have been designed around exactly these three actors.

What has changed in recent years is quieter but structurally significant: local government has been added as a fourth duty-bearer. A provision now sits within the law requiring local governments to cooperate with national policy and to independently establish and carry out their own measures for preventing industrial accidents within their jurisdiction. On the strength of that provision, the great majority of local governments across the country now maintain their own industrial accident prevention ordinances, through which they translate this duty into concrete regional activity.

Why local government was brought into the duty structure

The duties the Act assigns to central government are largely about national-level policy design and execution: setting and implementing safety and health policy, researching and disseminating prevention methods, running public campaigns to spread a culture of safety, and maintaining statistics on industrial accidents. The intent is not to leave prevention entirely to the discretion of individual workplaces, but to have the state provide an institutional foundation and a sense of direction, partly by channeling administrative and financial support through specialized bodies such as the Korea Occupational Safety and Health Agency.

National policy alone, however, struggles to capture the fact that industrial structures and hazard profiles differ sharply from one region to the next, and this is the gap that redefined the role of local government. The law now gives local authorities a basis to draw up their own regional plans, run education and outreach, and guide workplaces toward safer conditions. It reads as a deliberate attempt to close the space between policy set at the national scale and implementation that has to happen at the local one.

The blueprint for accident prevention is drawn at the national level, but it is the region where that blueprint meets actual terrain.

What actually sits inside these ordinances

Local governments give substance to this duty mostly through ordinances, and inside those ordinances sit a handful of distinct mechanisms, each aimed at a different facet of accident prevention.

The most visible is a corps of regional safety monitors, tasked with discovering, investigating, improving, and advising on hazards at workplaces and job sites. It functions as a supplementary safety net that can pick up the fine-grained risks routine inspection alone tends to miss, and it carries particular weight for smaller workplaces that inspection resources rarely reach.

A certification scheme for outstanding safety and health performance works differently: it offers management support funding and local tax relief to draw employers into voluntary participation. Rather than speaking the language of enforcement and penalty, it speaks the language of support and incentive, and it gives smaller employers, who often have limited room to invest in safety management, a concrete reason to act.

An annual prevention action plan, built by analyzing accident data and sector-specific conditions within the region, keeps the ordinance from being a one-time declaration and turns it into a plan renewed and re-costed every year. Around this sit softer instruments — a designated safety and health awareness period and a memorial day for workers affected by industrial accidents — that function as campaign-style reminders, extending what would otherwise be workplace-level effort into a broader civic concern.

A gaze aimed at the law's blind spots

The eligibility provisions of these ordinances make their real target clearer. Support is typically directed at workplaces with a small headcount, civil engineering and construction sites, specially-employed workers such as freight truck drivers, high-risk outsourced work in the public sector such as water management or cleaning, and migrant workers. Read together, this is local administration deliberately reaching into the vulnerable zones that sit somewhat outside the main regulatory framework of national law.

More recently, support for preventing death from overwork has been added to a number of these ordinances, widening the concept of industrial accident beyond physical injury to include circulatory disease and stress-related mental illness. The recent addition of support for adopting digital and AI technology likewise signals that the methodology of prevention is expanding from traditional inspection and training toward technology-based approaches — evidence that these ordinances keep being revised to track the times.

How a workplace can put this structure to use

The fact that the duty to prevent industrial accidents now extends beyond government, employers, and workers to local government as well means the pool of resources a workplace can draw on has widened accordingly. When preparing a risk assessment, a self-inspection, or safety training, it is worth reviewing the support programs and certification schemes run by the relevant local authority alongside it — often a practical way to supplement resources a workplace could not easily assemble on its own.

Accident prevention becomes a complete system only when national policy, local ordinance, employer action, and worker participation move as one continuous flow, and the role local government has newly taken on within that flow still has considerable room to grow more precise.
