The Labor Inspector Is Changing
What Korea's New Inspection Law Means for Workplaces
Korea's new Act on the Performance of Duties by Labor Inspectors does far more than rename an official title. It reorganizes the authority, procedures, data infrastructure, and central-local structure of labor inspection
From December 8, 2026, the familiar Korean title generally translated as “labor standards inspector” will be replaced by “labor inspector.” The change does not mean that the people currently carrying out inspections will suddenly disappear or that an entirely new enforcement body will be created. Existing inspectors will continue under the new statutory framework, and pending reports and other actions will carry over. What changes is not primarily the personnel but the legal architecture under which they perform their duties.
Until now, the powers and responsibilities used in workplace inspection have been distributed across the Labor Standards Act, the Occupational Safety and Health Act, and other labor-related statutes. The new Act on the Performance of Duties by Labor Inspectors consolidates the framework for workplace inspections, complaints, industrial accident prevention and investigation, administrative measures, monetary penalties, and judicial-police functions. The significance of the reform therefore lies well beyond a change of terminology.
This is not merely a new title — labor inspection is becoming a defined system
At the center of the new framework are central labor inspectors working within the Ministry of Employment and Labor and its affiliated offices. Their statutory duties extend beyond routine workplace visits and complaint handling. They include preventive enforcement of labor laws, industrial accident prevention and investigation, administrative penalty work, and judicial-police functions involving offenses under labor-related legislation.
The concept of “labor-related legislation” is itself broad. It encompasses not only traditional employment issues such as wages, working hours, and minimum wage compliance but also occupational safety and health requirements. Certain offenses under Korea's Serious Accidents Punishment Act also fall within the relevant judicial-police framework. For employers, this makes it increasingly difficult to treat labor management, occupational safety, and accident-related compliance as unrelated administrative silos.
This does not mean inspectors have suddenly been given an entirely new set of powers. Many of these authorities already existed in separate statutes. The major change is structural: powers, duties, investigation procedures, enforcement processes, and limits are now organized within a dedicated statutory framework for labor inspection.
The sign on the inspector's desk is not the real story. The real change is that labor inspection itself is being organized as a distinct enforcement system.
Inspections may be unannounced, but inspectors also have procedures to follow
The part employers are most likely to feel directly is the inspection procedure. The law divides workplace inspections into regular, ad hoc, and special inspections and establishes unannounced visits as the general principle. At the same time, advance notice may be permitted in situations to be specified by subordinate legislation. It would therefore be inaccurate to assume that every future inspection must occur without notice.
Where necessary, inspectors may enter workplaces and associated buildings, conduct on-site investigations, inspect machinery and equipment, and require the submission of books, documents, and copies of electronic information stored on digital media. The statute also expressly provides authority to question relevant persons, including employers, workers, and persons responsible for occupational safety and health.
Importantly, the statute does not define authority without defining procedure. Inspectors conducting an on-site investigation must present proof of identity and an official investigation directive stating the time, place, and scope of the inspection. Where products, raw materials, or equipment are taken for examination within the permitted scope, the employer must subsequently be informed of the results in writing.
Enforcement also continues after the visit. Where violations are confirmed, corrective measures follow; inspection findings are explained to the employer and worker representative, required corrective matters may have to be communicated within the workplace, and implementation can be checked afterwards. Inspection should therefore be understood as a process of verification, correction, and follow-up rather than as a single day's visit.
The law also provides a framework under which certain workplaces may be excluded from regular inspection for a defined period. That relief is not permanent: it can be withdrawn when circumstances such as numerous complaints, serious public controversy, a serious industrial accident, or another significant event creates renewed inspection needs. The system therefore contains both stronger enforcement architecture and a mechanism for differentiating inspection intensity.
As inspector authority becomes clearer, employers also need to understand exactly what is being inspected and what procedural limits govern the inspection.
Inspection may begin before an inspector reaches the workplace
One of the most consequential features of the new framework is its approach to information. Labor enforcement is no longer conceived solely as a process in which an inspector arrives at a workplace and begins collecting facts from scratch. The law provides a clearer basis for connecting labor-information systems with data already held by public authorities and related institutions.
The categories of information that may be requested are wide-ranging. They include business registration information, wage and business-income data, employment and industrial-accident insurance information, and data on insured workers and employment patterns. From an occupational safety perspective, relevant information may also include registration records for machinery or vehicles subject to safety inspection, certain chemical information, and in specific circumstances contracted electrical capacity used in safety-related administrative processes.
Particularly notable are emergency-response records. Rescue and ambulance activity records, emergency medical dispatch and treatment information, and certain survivors' funeral-benefit information under industrial accident compensation may form part of the information framework. None of these datasets automatically proves a violation. Their significance lies elsewhere: authorities can compare what a workplace reports with objective information generated outside the workplace.
The institutional map may also broaden geographically. The law creates a mechanism under which certain inspection authority concerning workplaces with fewer than 30 regular employees may be delegated to provincial or metropolitan governments, which may appoint local labor inspectors. This does not mean every small workplace will automatically be inspected by a local government. Local inspectors operate only within delegated authority and their territorial jurisdiction.
The larger direction is nevertheless clear. Labor inspection is moving toward a model in which central and local enforcement structures can cooperate, administrative data can assist in identifying risk signals, on-site inspections verify actual conditions, and inspection results feed back into the same information infrastructure.
Tomorrow's inspection may not begin when an inspector opens the factory gate. It may already have begun with the data.
The real preparation is not an “inspection file”
What, then, should a workplace do before December 8? The instinctive response may be to build an inspection manual or prepare a folder of documents that can be produced when an inspector arrives. That is useful only to a point. The more important task is to determine whether the workplace's records and actual operating conditions tell the same story.
Confirm that employment contracts, wages, working hours, workplace rules, and actual operating practices are consistent.
Risk assessments, safety training, work plans, inspections, and corrective actions should be reflected in actual working conditions rather than existing only as documents.
Digital attendance records, electronic approvals, inspection systems, and other operational data should be managed as carefully as paper records.
Decide in advance who verifies facts, provides documents, explains site conditions, and coordinates responses when an inspection or complaint arises.
This is especially important where HR, labor-relations, operations, and safety teams maintain separate records. An accident investigation may identify a hazard that never appeared in the risk assessment. A corrective action may be recorded as complete while the unsafe condition remains on site. Training records may show that instruction occurred while the worker's actual method contradicts the documented procedure. In such situations, the existence of paperwork can reveal inconsistency rather than demonstrate compliance.
Obstruction is also a poor response strategy. Refusing, obstructing, or evading authorized site investigations, inspections, checks, or collection activities; refusing to answer or making false statements during questioning; and failing to submit requested records or submitting false records may lead to an administrative fine of up to KRW 10 million. Failure to appear when formally required or failure to submit a required report, including false reporting, may result in a fine of up to KRW 5 million.
Preparing for labor inspection does not mean preparing documents to show an inspector. It means maintaining a workplace whose normal condition can be explained truthfully at any time.
After December 8, the most important question will still be the same
The new law does not suddenly create an entirely new universe of employment and safety obligations. Employers are already required to comply with labor standards, manage occupational risks, provide necessary safety and health training, maintain appropriate working procedures, and take steps to prevent industrial accidents.
What is changing is the mechanism through which those responsibilities can be identified, verified, and enforced. Inspector duties and authority are being consolidated within a dedicated statute. Central and local enforcement structures can be connected. Administrative datasets can assist in detecting signals that warrant attention, while on-site findings can be recorded and fed back into a shared enforcement system.
That means a single document will matter less in isolation. What matters increasingly is whether multiple sources tell the same story: whether the risk assessment matches the machine on the floor, whether corrective-action records match the condition actually observed, whether training records match what workers know and do, and whether working-time data corresponds with the way the workplace is actually operated.
Not every implementation detail is final simply because the effective date is approaching. The detailed conditions for inspection targets, advance notice, and delegation to local governments depend in part on subordinate regulations and operational standards. Employers should therefore review the final implementing rules as they are issued and adjust their internal compliance systems accordingly.
The best question for a workplace is therefore not, “When will the inspector come?” It is much simpler: if an inspector saw the workplace exactly as it operates today, could management explain its records, its decisions, and its actual conditions consistently and truthfully?
Even when the inspection system changes, the principle of preparation does not. Do not prepare for the inspector — build a workplace that remains stable when inspection comes.
